TWP Tours Risk and Liability Waiver

I, (also referred to hereafter as “the Participant”), in consideration of my participation in an international service tour (hereafter referred to as “the program) organized by Luciernaga LLC, DBA TWP Tours, registered in the state of Colorado, hereby agree as follows:

I understand that by signing this Agreement, I am waiving certain legal rights, including certain rights to sue for damages to property or personal injury, and am agreeing to binding private arbitration as a substitute for a lawsuit. I understand that I can consult an attorney if I have questions regarding the full scope and effect of this Agreement.

I acknowledge that TWP Tours is an international travel and educational program intended to benefit me, and that certain potential risks to personal health and safety are inherently associated with international travel and residence in a foreign country.

I acknowledge and agree that there are certain risks associated with international travel and residence, including exposure to health and safety hazards, including but not limited to transportation accidents, storms, floods, earthquakes, infectious diseases, reduced access to medical care, crime, civil insurrection, and terrorism. I acknowledge that TWP Tours cannot assume responsibility for persons, including other participants in the tour, who are not directly employed by TWP Tours, or for events beyond TWP Tours’ control.

I acknowledge and agree that the my participation in TWP Tours' program is purely voluntary and with full knowledge of the risks enumerated above, and the fact that there are other risks associated with the experience that cannot be foreseen or enumerated, I assume all risks associated with my participation in TWP Tours' program.

I agree to release, indemnify, and hold TWP Tours harmless, its officers, directors, trip leaders, employees, independent contractors, and agents, for all claims known and unknown, foreseen and unforeseen, that I may have arising from, or in connection with, any physical, emotional, or property damage that I may suffer from any cause whatsoever other than the intentional misconduct of the foregoing. I release TWP Tours from, and agree not to sue TWP Tours for, any physical, emotional, or property damage, that I may suffer from acts of God, war, strikes, government restrictions, terrorist activities, or the acts or omissions of any other agents over which TWP Tours has no direct control, including but not limited to, airlines, bus companies, railways, shipping companies, hotels, guides, and subcontracted agents or tour operators. I intend that this release be construed as releasing TWP Tours to the fullest extent permitted by law.

I acknowledge that I have no past or current physical or psychological condition that might prevent my safe participation in tour activities, or which may present a danger to myself or others. I have informed TWP Tours of all prescription medications I shall be using during the trip, and of any medical conditions that may affect my participation in tour activities.

If I become ill or incapacitated, TWP Tours may take any action deemed necessary for my safety and wellbeing, including securing medical treatment and transporting me home. If my ability to make health care decisions is impaired while participating in TWP Tours' program, I authorize Trees, Water & People to direct medical professionals to provide care it deems necessary for my wellbeing. I represent and warrant that I will have health insurance in force during the period of my participation, and acknowledge that any expenses not covered by my own health insurance or by any supplementary health insurance, shall be my sole responsibility.

I agree that I will abide by all local laws while participating in TWP Tours' program, and further agree that I will refrain from consuming or using any drugs for which I do not have a current prescription while participating in TWP Tours' program, regardless of the legality of the substances under local law.

This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein, and I do not rely upon any promises, inducements, or arrangements not contained herein, including but not limited to any oral statements made by any agent of TWP Tours or any statement in the TWP Tours promotional materials. This Agreement may be amended or modified only in writing signed by all parties.

This Agreement shall be governed by the laws of the State of Colorado. Any claim or controversy arising hereunder or relating hereto shall be settled by arbitration, before an arbitrator who is a licensed attorney, in Larimer County, Colorado, and conducted in accordance with the rules of the American Arbitration Association then in effect. The award rendered by the arbitrator shall be final, and judgment may be entered in accordance with applicable law of any court having jurisdiction. A demand for arbitration shall be made within six months after the claim, dispute, or other matter has arisen, and in no event shall a demand be made more than 12 months after the date of the termination of my participation in TWP Tours. The venue of any suit regarding any claim or controversy arising hereunder shall be Larimer County, Colorado.
